Shot in the foot, again & again!

Anwar is quick on his feet, not like someone we all know too well, the one with tendency to shoot himself in the foot again and again in no matter what he do. Just look what he got himself into today? Loads of explanations to give to other component parties in BN for his secret rendezvous with PAS. And all that for what? To top that up, now he got Anwar Ibrahim and a by-election in Permatang Pauh to deal with.

What do I think about the by-election? My hats off to Anwar, really. He is a maverick and one shrewd politician. With that, the decision made by the missus & him, it is now:-
  • highly unlike any action will be taken against him during this time with regard to the on-going criminal investigation. Any action against a potential by-election candidate of his magnitude and stature, especially now, will not augur well in the eyes of the international community, especially in the eyes of the world police, the great US of A (another soap opera in the making?);
  • near impossible that he will lose in the by-election. After all Permatang Pauh to him is what Kepala Batas is to Paklah. And he by playing safe this time is actually playing smart. Ezam will be fried, before he knows it, if he wants to take on Anwar mano-a-mano in Permatang Pauh. What's that? Pirdaus, who?;
  • most probable that Paklah will start to sleep less from now on due to constant nightmares of Anwar's return to Putrajaya (unless of course that was the plan all the while);
  • officially confirmed that there will be no UMNOPAS, PASUMNO or what not. What muqabalah when both parties are about to go into "battle royale" in Permatang Pauh? Salute to PAS (Majlis Syura triumphed over the President, UMNO should take lessons from PAS). UMNO have just been Punk'd.
Paklah might as well give Anwar a walk-over. Save that money-lah!

Kebolehterimaan Keterangan

Berkenaan gembar-gembur kontroversi "laporan perubatan" bagi menunjukkan bahawa Anwar Ibrahim adalah tidak bersalah, saya kira beberapa nukilan di dalam blog-blog Minda Intelek Melayu dan drraffick, kedua-dua blogger adalah pengamal perubatan, berkaitan laporan yang penuh kontroversi tersebut di sini, sini dan sini sudah cukup untuk memberikan kita serba-sedikit pemahaman berkenaan apa yang yang tersurat dan tersirat di dalam laporan tersebut.

Dari sudut undang-undang pula, terutama Undang-Undang Keterangan, sememangnya benar laporan tersebut boleh diterima-masuk sebagai keterangan di dalam perbicaraan, jika ada, kelak asalkan ianya memenuhi syarat-syarat yang ditetapkan di bawah undang-undang berkaitan.

Baik pendakwaraya mahupun peguambela boleh memperkenalkan kepada mahkamah keterangan tersebut semasa perbicaraan dan memohon untuk ianya diterima-masuk sebagai keterangan sekiranya benar doktor tersebut sememangnya pegawai perubatan pertama yang memeriksa pesakit berkenaan dan pemeriksaan telah dijalankan ke atasnya, waima apa kaedah pemeriksaan sekalipun yang dilakukan pada masa tersebut, asalkan ianya releven dengan kes yang dibicarakan.

Walaubagaimanapun, memandangkan keterangan yang dibincangkan di sini adalah keterangan bertulis, beberapa kaedah-kaedah undang-undang keterangan perlu dipenuhi sebelum keterangan tersebut boleh di terima-masuk sebagai bukti dalam perbicaraan.

Apa sekalipun, kesahihan keterangan tersebut adalah yang utama dan kaedah-kaedah keterangan berkaitannya perlu dipenuhi sebelum diterima-masuk ke dalam mahkamah sebagai barang bukti. Sebagai kaedah am, pembuat keterangan tersebut, di sini, doktor yang dikatakan memeriksa, hendaklah dipanggil semasa bicara, bagi mahkamah untuk menerima-masuk keterangan bertulis beliau.

Namun demikian, seandainya diterima-masuk pun, di bawah seksyen-seksyen 136 dan 167 Akta Keterangan, sesuatu keterangan tersebut tidak (di dalamnya atau padanya) membuktikan secara automatik kebenaran fakta yang berkait dengannya. Juga perlu diingatkan, walaupun diterima-masuk sebagai keterangan di dalam sesuatu perbicaraan, tidak semua keterangan akan diberi nilai atau berat yang sama bagi seseorang hakim apabila menilai keterangan-keterangan yang dikemukakan di akhir perbicaraan kelak.

Terpulanglah kepada soal utama, soal-balas, soal semula oleh peguam dan pendakwaraya, kredibiliti saksi dan punca keterangan diperolehi, konsistensi keterangan tersebut dengan keterangan yang lain, sama ada keterangan tersebut dari pihak yang mempunyai kepentingan dan segala keterangan sokongan terhadap keterangan berkenaan. Pendek kata, tunggu sahaja masa perbicaraan kelak, jika ada, pasti ianya akan diketengahkan oleh peguam dan pendakwaraya.

Namun apa yang menghairankan adalah kenapa pihak-pihak yang berkenaan seolah-olah menerima bulat-bulat keterangan yang kontroversial ini (dengan interpretasi mereka sendiri) dan menggesa kes ditutup sebelum siasatan polis diselesaikan dan sebelum kes di bawa ke mahkamah, jika difikirkan sesuai oleh pendakwaraya, untuk dibicarakan? Sedangkan pihak-pihak inilah yang sering melaung-laungkan pemulihan sistem kehakiman serta ketelusan dan kebebasan pihak polis di negara ini.

Kenapa perlu dua pendekatan yang berbeza di sini (yakni "siasat habis-habisan" di dalam kes-kes lain tetapi "berhentikan siasatan" di dalam kes yang satu ini)? Apa keistimewaan kes ini berbandingkan kes-kes yang lain di dalam siasatan?

UMNO: A political tsunami from within?

High hopes are being rested upon the weary shoulders UMNO's ordinary members currently at the branches level, to re-send the signal to their President that he and his team are no more needed and that he can't unilaterally decides when and how he's going to go. What transpired today as being blogged by BigDog and Rocky hopefully would do some good and set a precedent to other branches of UMNO which are yet to convene their branch level meetings.

UMNO members should demonstrate to the outside world that their party is actually in its way to heal itself and not on a self-destruct mode as currently perceived by many. They must always remember that whatever the outcome in UMNO elections this coming December will shape the path and future, not only their party, but the nation itself. Be sincere to yourself and your fellow Malaysians. Don't be selfish. There's simply too much at stake.

As being succinctly put by some UMNO leaders that politics is the art of impossible when asked about the possibilities of UMNO-PAS merger, the same should apply when it comes to removal of an incumbent, notwithstanding the fact that he is currently the President of UMNO and the Prime Minister of Malaysia. Nothing is impossible.

3 PAS MBs, 3 Different Tones



The 3MBs from PAS were getting wide media coverage today, especially from the MSM.

Perak MB; (as reported by The Star)

“As far as PAS in Perak is concerned, we will be in Pakatan Rakyat forever and ever," Nizar said.

“There is no way we will pair with them (Umno). We are the Pakatan Rakyat, a composition of PAS, DAP and PKR,” he said in a press conference after chairing the Perak Water Board meeting here on Monday.

Kedah MB; (Bernama)

"PAS, DAP and Parti Keadilan Rakyat (PKR) only cooperated as Pakatan Rakyat to face the Barisan Nasional (BN) in the general election. (It is) not an alliance like BN," he said.

"Malaysia is a free country and why must we follow others' instructions," Azizan said when asked to comment on DAP chairman Karpal Singh's statement that the PR review PAS' participation following its action of having discussions with Umno on Malay unity.

"Karpal himself had said that it would be over his dead body if the PR would talk to Umno. PAS has done so. Now it is up to him (to take further action)," Azizan said.

KUALA LUMPUR, July 28 — After rejecting a muzakarah (dialogue) with Umno, Datuk Nik Abdul Aziz Nik Mat surprised everyone over the weekend by asking Umno and Pas to dissolve and pave the way for a united Muslim party.

To prove his seriousness, the Pas spiritual leader will bring up the proposal at the Pas
muktamar (annual meeting) in Ipoh next month.

"The muktamar will give me an opportunity to present my case," the Kelantan menteri besar told reporters in Kota Baru yesterday. Nik Aziz has been vehemently opposed to the idea of Pas leaders discussing political matters including cooperation with their Umno counterparts.


Now as I have stated earlier on I do believe that we do need to look at what's going on concerning the "merger" from a bigger perspective, from a wider angle. If you'd make some times tonight to visit Harakah Daily, they are not highlighting any of this. In fact what seems to be the main news in that particular web portal (see above pic) is Umno gagal gugat Pakatan Rakyat - Anwar

The mixed messages sent out are actually clear enough for anyone to decipher. It is whether you can swallow it or otherwise would be the issue, very much depending so on where you're coming from.

Siapa "check-mate" siapa?

Rata-rata ahli UMNO menerima dengan penuh kesenangan berita keretakan Pakatan Rakyat, tambahan lagi bila DAP bersuara mempersoalkan keikhlasan PAS di dalam pakatan tersebut. Saluran Media Perdana (MSM) begitu ghairah melapurkan isu tersebut. Gembar-gembur Tuan Guru Nik Aziz mencadangkan pembubaran kedua-dua parti terlibat dalam muqabalah dan pergabungan semula sebagai entiti lain dilaung-laungkan oleh saluran-saluran televisyen kerajaan dan pro-kerajaan.

Malahan terdapat beberapa menteri kabinet termasuklah Menteri Penerangan mencanangkan perasaan optimis mereka terhadap perkembangan ini. "Tidak Mustahil" kata mereka.

Persoalan yang saya ingin ketengahkan di sini adalah siapa yang sebenarnya sedang melakukan langkah untuk "check-mate" siapa? Menarik! Saya terpanggil untuk membuat beberapa andaian dan observasi di sini. Izinkan saya.

Pertama, bagi pihak UMNO, sudah tentulah mereka ghairah dengan perkembangan mutakhir ini dan akan terus melaung-laungkan kesanggupan PAS duduk semeja dan berbincang untuk mencari satu titik persefahaman ke arah penggabungan dua parti ini. Masakan tidak dicanangkan, ianya adalah satu perkara yang boleh menjadi katalis dan "batu-api" kepada keretakan permuafakatan musuh politik mereka.

Tetapi politik ini adalah permainan mereka yang licik. Bukan calang-calang manusia yang boleh bermain politik ini. Gelanggang ini hanya untuk mereka yang bijak-bijak belaka (ataupun mereka yang merasakan diri mereka bijak).

Di dalam BN sekarang, siapa yang sudah mula menampakkan ketidak-senangan mereka terhadap perkembangan mutakhir yang berlaku pada UMNO ini? MCA, melalui bakal calon Presiden mereka Ong Tee Keat telahpun mula bersuara, walaupun masih bersulamkan madu, akan keresahan MCA sekiranya berlangsungnya majlis "jejak kasih" PAS & UMNO kelak. MIC ? Gerakan? Tidaklah perlu kita tanyakan, lihat sahaja kepada sandiwara nama-nama jalan di P.Pinang tempohari. Parti-parti komponen yang lain di Sabah & Sarawak? Apakah Presiden UMNO sudah lupa "pesta hendak keluar parti" baru-baru ini?

Mari kita andaikan bahawa PAS sebenarnya sedang bersandiwara dengan UMNO (dengan persetujuan ahli-ahli pakatan mereka, DAP dan PKR), untuk membuai UMNO dengan mimpi indah menerajui semula beberapa buah negeri yang terlepas daripada tangan mereka pada pilihanraya yang lepas dengan ulitan yang merdu lagi mengasyikkan, sehingga beradu nyenyak UMNO dibuatnya.

Sekiranya PAS dikatakan sedang ber"main belakang" dengan UMNO, sudah pasti Anwar Ibrahim dan Lim Kit Siang boleh atau mungkin sedang melakukan perkara yang sama dengan MCA, MIC dan rakan-rakan UMNO yang lain di dalam BN termasuk yang berada di Sabah & Sarawak. Tidak salah bukan? Lagipun UMNO sedang lena nyenyak dibuai mimpi indah bertaut kembali dengan PAS kelak. Inilah masanya langkah pemati pencak silat politik wajar dilangsungkan. Bila lagi?

Seterusnya, lagi seronok permainan politik ini seandainya dimasukkan serba sedikit unsur teaterikal di dalamnya. Hari ini sahaja kita lihat seorang pemimpin DAP dengan terang-terang mempersoalkan keikhlasan PAS. Esok mungkin mereka di dalam PKR pula akan bersuara.

UMNO pula akan terus alpa, diulit mimpi indah menjadi kerajaan semula di beberapa negeri lantas sekaligus menamatkan riwayat politik Anwar Ibrahim. Ghairah dengan sangkaan bahawa mereka sedang memporak-perandakan rumahtangga musuh mereka sedangkan rumah mereka sendiri, yang sememangnya tidak terurus, itulah yang sedang diporak-perandakan orang.

Walau apa pun taktik mereka kali ini, PAS pada pendapat saya tidak akan rugi apa-apa, malahan mereka sebenarnya (dengan memulakan langkah muqabalah ini) telahpun menjadi "golongan bebas" yang diwar-warkan oleh Che Det sebelum ini (apabila beliau menyarankan ahli-ahli parlimen BN untuk keluar daripada pakatan Barisan Nasional dan menjadi "king maker" dan "pendesak" kepada siapa memegang tampuk pemerintahan negara) dan akan mempunyai kuasa tawar-menawar yang amat besar di dalam permuafakatan Pakatan Rakyat itu sendiri. Jurus dan langkah pencak PAS bertambah baik sejak kebelakangan ini.

Akhir sekali, persoalannya, siapakah yang sedang "check-mate" siapa sekarang ini?

P/S: Ini hanya andaian daif daripada saya sahaja yang sememangnya jahil mengenai politik.

DAP Wants Pakatan Rakyat To Review PAS Membership

KUALA LUMPUR, July 28 (Bernama) -- Cracks are beginning to emerge in the three-party opposition coalition Pakatan Rakyat, with DAP openly declaring it now wants the alliance to review PAS' membership in the grouping.

DAP national chairman Karpal Singh said PAS had thrown grave doubts over its credibility, adding that Pakatan Rakyat should seriously consider, in view of events of late, whether PAS should be allowed continued membership in the alliance.

"The assurance by PAS president (Datuk Seri) Abdul Hadi Awang to Pakatan Rakyat partners (Parti Keadilan Rakyat and DAP), that PAS will not abandon the alliance to join the BN, is not bona fide and is not supported by past events.

"After the March 8 general elections, PAS had talks with Umno to form a coalition government in Selangor.

"This was an act of bad faith as both DAP and PKR were not informed of such a move by PAS," he said in a statement, Sunday.

Oh, how I cringe every time I switched on the TV or read the news on Terengganu of late. How could I not? Just look at this, the jokers are still at it!

Terengganu folks, are these the YBs you intended to vote to be in office in the first place? Are you sure that these are the same people that solicited your votes on March 8th, 2008?

The biggest kahuna over there joined in the fun, just to spice things up and said these last night;

He said the ACA had taken the Proton Perdana cars that were used by the state executive councillors and officers.

“So the executive council members and officers will have to use the Mercedes...the prime minister had also said that (we) can use the Mercedes cars once in a while,” he told reporters at a dinner with state Umno leaders here last night.

Is there no other bigger agenda for Terengganu on the plate other than to satisfy these voracious elected representatives?

So the cars have been detained by ACA. That's why they have been using the mercs (especially those who have been reported by The Star today). Therefore it is justifiable. They don't even have their own private cars to start with, I presumed. No other choice! On that score alone it is okay for them to defy government rulings and simple instruction by the PM and the cabinet.

Kepimpinan Melalui Teladan indeed!

Antara Impian & Realiti

Perdana Menteri, Datuk Seri Abdullah Badawi dan barisan kepimpinan UMNO yang senada dengannya begitu kuat mencanangkan muqabalah antara PAS & UMNO. Semangat untuk berbincang dan mencapai titik persefahaman ke arah menjitukan perpaduan ummah Melayu & Islam di negara ini jelas kelihatan di dalam tutur-kata mereka ini sehinggakan ianya seolah-olah merupakan agenda utama UMNO di dalam masa yang terdekat ini.

*Melayu itu orang yang bijaksana
Nakalnya bersulam jenaka
Budi bahasanya tidak terkira
Kurang ajarnya tetap santun
Jika menipu pun masih bersopan
Bila mengampu bijak beralas tangan

Begitu juga dengan Presiden PAS, Datuk Seri Hj Hadi Awang. Walaupun tidak keihatan begitu beria-ia sepertimana rakan sejawatnya di dalam UMNO, beliau juga menyifatkan cadangan tersebut sebagai satu "anjakan" kepada rakan sejawatnya dalam UMNO tersebut.

Bagaimana pula "angin" di peringkat akar-umbi kedua-dua parti politik yang dikatakan menjadi tunjang dan tonggak orang Melayu di negara ini? Daripada observasi saya, ahli-ahli PAS sendiri tidak begitu pasti hala dan tujuan perubahan "angin" yang di bawa oleh kem muzakarah/muqabalah PAS sehinggakan seolah-olah wujud dua kem di dalam PAS masa kini. Sehinggakan Tuan Guru Nik Aziz mengeluarkan sindiran pedas tapi bermakna bila meminta bubarkan UMNO dan PAS, bikinlah satu parti yang baru mewakili semua orang Melayu, semua orang Islam.

Saya baru pulang bertemu seorang sahabat sebentar tadi. Sambil minum teh tarik saya cuba mendapatkan reaksi beliau, yang juga merupakan seorang ahli UMNO yang cukup setia kepada partinya dan penjawat jawatan utama salah satu bahagian UMNO di Kedah.

Apa yang dapat saya rumuskan daripada sembang-sembang kami tadi, ahli-ahli UMNO sendiri juga sama-samar tujuan halatuju presiden mereka berkaitan dengan muqabalah dengan PAS ini. Apa yang jelas, sahabat saya ini juga tidak begitu optimistik berkenaan dengan niat sebenar presiden beliau.

"UMNO sendiri di dalam perpecahan, bergaduh sana-sini, rebut jawatan sana-sini dia dok sibuk dengan nak menyatu-padu orang Melayu, kununnya" itu kata beliau sebelum kami beralih ke topik lain.

Sambil memandu pulang ke rumah selepas itu, terlintas di dalam hati saya kenapa sekarang? Kenapa tidak selepas pemilihan UMNO? Kenapa tidak selepas muktamar Agung PAS? Survival siapa sebenarnya yang menjadi agenda muqabalah ini, orang Melayu kah atau individu tertentu?

*Malangnya Melayu itu kuat bersorak
Terlalu ghairah pesta temasya
Sedangkan kampung telah tergadai
Sawah sejalur tinggal sejengkal
tanah sebidang mudah terjual

Siapakah yang untung dan siapakah yang rugi sebenarnya jika perbincangan dan permuafakatan ini menemui jalan buntu kelak? Peratusan untuk ianya menemui kebuntuan adalah amat tinggi dan sejarah telahpun membuktikannya bila perpaduan ummah dijadikan bola di atas padang permainan politik. Bukan saya anti kepada perpaduan Melayu, cuma inilah hakikatnya, antara antara impian dan realiti.

Meski telah memiliki telaga
Tangan masih memegang tali
Sedang orang mencapai timba.
Berbuahlah pisang tiga kali
Melayu itu masih bermimpi

Sayugia diingatkan bahawa pertemua dua parti ini adalah hanya pertemuan dan perrbincangan 2 entiti politik semata-mata dan wujud bahananya yang tersendiri seandainya ia ditafsirkan sebagai wacana permuafakatan Melayu sejagat. Tidak semua orang Melayu di dalam UMNO & PAS, ada yang berada di dalam parti-parti politik lain semenanjung mahupun di Sabah & Sarawak. Malahan ramai lagi yang apolitikal, tidak pun berada di dalam mana-mana parti politik.

*Berdamai cara Melayu indah sekali
Silaturrahim hati yang murni
Maaf diungkap senantiasa bersahut
Tangan diulur sentiasa bersambut
Luka pun tidak lagi berparut

Sampai bila indeks aras penanda perpaduah ummah Melayu perlu dihalakan kepada PAS & UMNO sahaja? Tidak semua orang Melayu melihat bahawa perpaduan dan permuafakatan itu adalah hanya melalui jalan politik.

Baiknya hati Melayu itu tak terbandingkan
Segala yang ada sanggup diberikan
Sehingga tercipta sebuah kiasan:
"Dagang lalu nasi ditanakkan
Suami pulang lapar tak makan
Kera di hutan disusu-susukan
Anak di pangkuan mati kebuluran"

Politik adalah bukan segala-galanya.

Of Libel & Slander

What is Libel & Slander?

Defamation may be a criminal or civil charge. It encompasses both written statements, known as libel, and spoken statements, called slander. English law allows actions for libel to be brought in the High Court for any published statements which are alleged to defame a named or identifiable individual or individuals in a manner which causes them loss in their trade or profession, or causes a reasonable person to think worse of him, her or them.

A public official or other plaintiff who has voluntarily assumed a position in the public eye must prove that defamatory statements were made with knowledge that they were false or with reckless disregard of whether they were false.

Now, someone who is currently away, is considering whether to proceed with legal recourse against the relevant parties concerning statements issued and news report made with regard to his previous official car's maintenance costs and the innuendos made pertaining to his previous administration due to the same.

Yes, IJ is NOT taking it lying down. It's about time; I do think so myself considering the shenanigans and mischievous politicking by some quarters against him. What legal action then? It could well be the above branch of tort. In time we shall know. By the way, were there any direct official apologies made by the parties concerned to him? I don't think so

Idris Jusoh Appoints Lawyer Over Perdana V6 Maintenance Statement

BESUT, July 25 (Bernama) -- Former Terengganu Menteri Besar Datuk Seri Idris Jusoh has appointed a lawyer to study what action to take over a statement that maintenance of his Proton Perdana V6 Executive was highest among the State Executive Council (Exco) members.

His special officer Kamarulazman Idris said the move was necessary as the statement had tarnished the reputation of Idris, the State Assemblyman for Jerteh.

He said although the state government had apologised, the statement showed that the Terengganu leadership had acted in haste without thinking of the consequences.

"Terengganu people are confused by the claim that the maintenance of Idris' Proton Perdana V6 Executive when he was the Menteri Besar was the highest," he said in a statement Friday.

Kamarulzaman said the issue should not be politicised as it could tarnish Idris' image especially when he was away and could not reply.

PUTRAJAYA: Prime Minister Datuk Seri Abdullah Ahmad Badawi has clarified that the 14 Mercedes E200 Kompressors purchased by the Terengganu government for RM3.43mil would be used for visiting foreign dignitaries.

He said that this was the decision he reached with Deputy Prime Minister Datuk Seri Najib Tun Razak after speaking with Terengganu Mentri Besar Datuk Ahmad Said on Thursday.

Earlier Friday, Ahmad said, "We (Abdullah and Najib) reached a consensus on the matter during the meeting at Putra World Trade Centre (on Thursday). The matter has been solved."

The Terengganu government was criticised recently after it purchased 14 Mercedes E200 Kompressors for RM3.43mil.

Ahmad said both leaders have told him that the matter is solved and should be laid to rest.

The Belligerent MB (2)

I heard over the news at TV3 (Buletin Utama) just now that somebody is in trouble for the purchase of 14 brand new E200 Mercs for Terengganu State Government for failing to adhere to standard government practice & procedure.

It was also mentioned during the news that ACA is also investigating whether there were elements of malpractice and corruption (abuse of power) for the said purchases. It was further mentioned that there were mistakes on the amount mentioned as the maintenance costs for the previous MB's official car. Unfortunately it was not elaborated further during the news. We shall know soon enough.

Apparently some of the MBs agreed with the fact that maintenance costs for the Perdana V6 is costly then the merc. Read Pahang, Kelantan MBs back Terengganu over Perdana car maintenance cost and here.

They may have a point, but they must understand that the crux of the issue is with regard to the timing. Now is not the time. You don't go and splurge your reserves and indulge in an extravagant expense or luxury when you are at the same time asking the rakyat to tighten their belts. Know your priority, practice what you preach!

Having said that and in the event there was hanky-panky or abuse of power, one must face the music. What goes around comes around. You'll reap what you sow. No one shall be excluded.

The Belligerent MB


Combative as ever the Terengganu MB stood his ground. "Pugnacious" is one of the two words for me to sum up this fellow. The other one is "nitwit". Regardless of what have been said, he would not resign to the fact that such purchases were wasteful and not in accordance with the prescribed government rules & regulations.

Over lunch today when asked by one of my client about this issue, I was at loss for words. What is there for me to say? Despite being reprimanded by the cabinet, he's just not buying it. He retaliated with flimsy reasons together with unsubstantiated, uncorroborated and caustic examples and justifications, one after the other (the last being his predecessor's perdana v6's maintenance billings). Finally yesterday, as his latest salvo against the cabinet, he came out with his version of interpretation of a particular Treasury Circular.

He is one superhero indeed! Don't be surprised if he comes back after all this with Paklah's or Najib's car services bills and costings!

And that also goes to show how much control the Head Honcho of Malaysian government has currently and the level of respect that he commands. Despite all this, he is still impervious to pleas and signals by the rakyat and adamant as ever to give it a go as the PM for another 2 years.

I wonder why a Terengganu Exco Meeting was held in Kuala Lumpur's Le Meridien. Another cost-cutting measures by the state government, perhaps?

Nonetheless, it must be an awesome sight! A convoy of 14 brand new mercs coming all the way from KT to KL. Bila lagi mau try kereta baru! And the destination? The posh Le Meridien KL-lah to complement it all. Ada class-lah!

Anyway, how was the merc? Was the ride comfy and did you feel safe and secured enough , Datuk "MercSaid"?

It must be, after all it's a Merc, not some lousy Perdana V6!

Pas & UMNO

Saya cuba mengelak untuk menulis berkenaan isu "muzakarah/dialog PAS-UMNO".

Banyak sudah yang kita boleh baca dan halusi daripada media massa perdana mahupun alternatif dan juga dari sembang dan cakap-cakap di kedai kopi berkenaannya.

Tetapi hari ini saya tidak boleh mengelak lagi. Menarik artikel blog Penarik Beca hari ini. Ianya membuat saya terpanggil untuk menulis. Apa yang saya hendak war-warkan di sini adalah bukan masalah dalaman di dalam parti tersebut, tetapi idea bahawa teguran terhadap pemimpin hatta yang paling teratas sekali pun, wujud di dalam PAS. Ianya wujud secara sihat dan tidak dikekang dengan ketaksuban terhadap pemimpin seperti yang wujud di dalam UMNO.

Sedikit petikan tulisan saudara Bakaq @ Penarik Beca;

Antara sifat Tok Guru Presiden yang saya tak lupa ialah beliau tak pernah puji diri sendiri . Tetapi Tok Guru bukan manusia suci yang bebas dari kesilapan. Jangan mentaqdiskan Tok Guru Presiden atau Tok Guru Mursyidul Am. Mereka bukan manusia suci. Namun, hakikat itu tidak sepatutnya dijadikan lesen untuk membantai mereka.

Bagi saya inilah yang menjadi daya tarikan kepada golongan muda untuk mendekati parti ini sepertimana tertariknya kita apabila untuk hadir mendengar celoteh dan dakwah Ustaz Akhil Hayy yang begitu aktif di pentas PAS suatu ketika dahulu. Nah, sekarang kita boleh lihat, bahkan vokalis kumpulan Search juga akan berada di pentas PAS. Lahirnya kepimpinan muda seperti Husam Musa dan lain-lain juga mencerminkan peralihan parti ini kepada genre yang lebih pelbagai tetapi tetap bertunjangkan Islam sebagai paksinya.

Pimpinan UMNO perlu sedar, "talian hayat" (memetik kata-kata blogger Penarik Beca) parti mereka sudah tiada. Segala taktik sudah di baca orang, baca sahaja nukilan blog Penarik Beca di atas, segalanya sangat jelas. Muzakarah atau dialog tanpa keikhlasan hati pasti tidak akan membuahkan hasil.

Apa yang perlu dilakukan adalah perubahan dari dalam, dari akar-umbi parti itu sendiri. menerobos terus sehingga ke pucuk pimpinan parti tersebut. Jika pucuk pimpinan ini masih lagi khayal dengan dibuai oleh media arus perdana yang sama sekali membutakan mereka daripada perubahan angin rakyat jelata masa kini, walhal pilihanraya lepas sudah jelas memberikan mesej, nescaya pimpinan UMNO akan melihat sokong membawa rebah di Pilihanraya akan datang.

Unsur-unsur ketaksuban terhadap pemimpin, budaya mengipas dan lain-lain yang tidak perlu saya ulangkan di sini, perlulah di buang jauh-jauh. Hairan kenapa masih tercari-cari formula untuk mengembalikan kemegahan lampau. Sudah terang, kenapa perlu bersuluh?

But Malaysian nation-building has gone backwards and the Vision 2020 objective of a “Bangsa Malaysia” is increasingly frowned upon as a misplaced target.

Has he forgotten another of his pledges to be the Prime Minister of all Malaysians and not just for any race?

...what's going on with his son? Is he on other hand venturing into promoting geographical segregation and demarcation of boundaries according to ethnicity?

He was reported to say as follows;

He said multilingual signs would be used according to the historical, cultural and ethnic background of people in specific areas.

For example, areas with a Malay background would see the inclusion of Arabic, Tamil would feature in Little India and Chinese in Chinese areas.

Why the change in tone?

That line of speech is somewhat in stark contrast of Anwar's speeches we have been hearing for the past months. Sign of confidence slowly eroding away?

Some senior Pas politicians are also troubled that Anwar appears to be setting the agenda for the Opposition. In their view, no one has been elected as the leader of Pakatan Rakyat nor is there an official framework of agreement between PAS-PKR-DAP.

Or simply put, telling tales of a tale that never was?

And what "elections" he was talking about last night? Isn't that part of the plan all the while. Other backdoor entry in mind for the PKR de facto leader?

Released on police bail

Datuk Seri Anwar Ibrahim was released on police bail Thursday morning after having his statement recorded the night before, the Deputy Inspector-General of Police Tan Sri Ismail Omar said.

He was safely back at his home in Bukit Segambut in Kuala Lumpur by 10.05am.

Anwar's statement was taken down to facilitate police investigations into the report lodged on June 28 by his 23-year-old former aide Mohd Saiful Bukhari Azlan alleging he had been sodomised by the PKR de facto leader.

Kudos to the authorities for finally getting their act together despite having started the whole affair on the wrong footing, balaclavas et al. Now let the law takes its course.

The masked men....

This is what the CID Chief (click, to read what zulkilfli nordin blogged) has to say about the arrest. Read CID chief: Police acted in accordance to guidelines . I feel safe already!

An excerpt of the above Malaysian Insiders news report;

"To ensure that a successful action would be taken by PDRM (the Royal Malaysian Police Force), PDRM required an organised and perfect plan,"

"PDRM had taken into consideration the security angle of the operation that was conducted, whether it be the security of the police officers carrying out their duties, or the individual who was acted upon."

"Security is the most important thing in an operation. PDRM has rules in performing duties and responsibilities placed upon the police. This action was done according to the existing guidelines," Bakri said.

Alright, the police are only doing their job. We understand that. Procedure wise, I do not want to comment. I don't have the warrant of arrest with me and I was not there at the place where the arrest was made. Let's Anwar's lawyers deal with that. We are clear on that.

Why arrest Anwar? We are all aware of that too. Satu Malaya sudah tahu! We understand that there was a report and he must be investigated and if there is enough evidence, to be charged in the court of law and to be tried like anybody else. No one is above the law.

But, why the intimidation and high-handedness? Why the men in masked? And to the deputy minister concerned, there actually is a difference between 20 to 50 minutes time, especially so when there was a dateline given and there was an agreement of sort between the parties involved. Time is always an essence in matter of law. Don't just assume.

What civility?


We are on the right track, alright! What civility? Read this, and tell me where are we heading to.

Bahas: Ke arah masyarakat sivil

Sepanjang perbahasan tadi, saya tidak dapat mengelak daripada memikirkan bagaimana jika diletakkan Abdullah sebagai lawan Anwar dan bukannya Shabery.

Ternyata dari awal, debat berkenaan adalah milik Anwar. Shabery mungkin terlupa pantang larang utama apabila berdebat bila daripada awal lagi kelihatan menyerang Anwar secara peribadi. Jelas emosi menguasai Shabery daripada awal hingga ke akhir debat. Lihat sahaja siapa yang menghulurkan tangan terlebih dahulu apabila perbahasan berakhir? Anwar telah berjalan kepada Shabery dan menghulurkan tangan.

Namun demikian tahniah wajar diberikan kepada Shabery kerna sanggup turun ke gelanggang mempertahankan dan memperjelaskan tindakan-tanduk eksekutif yang diambil oleh kabinet yang dianggotainya. Namun demikian debat adalah debat, dan apabila berdebat keberanian bukanlah faktor tetapi isu hujahan yang selaras dengan tajuk perlulah diutarakan. Pencadang dengan cadangannya dan pembangkang dengan bangkanganya. Sayang sekali kepada Shaberi kerana tajuk debat berkenaan adalah jelas, maka apa yang shabery patut utarakan adalah kenapa ianya tidak boleh dilaksanakan. Itu sahaja.

Anwar pula sebagai pencadang dengan bijak telah mengutarakan cadangan-cadangan yang dianggap “populist” oleh Shabery. Salah satu pematahan yang jelas daripada shabery yang saya kira boleh diterima, sebagai penghalang kepada cadangan-cadangan Anwar, tidak diperjelaskan dengan lebih lanjut oleh menteri berkenaan adalah atas isu IPP. Shabery mengatakan cadangan berkenaan IPP yang diutarakan oleh Anwar tidak boleh dilaksanakan kerana obligasi kontraktual yang mana mengikat kerajaan. Saya berharap Shabery boleh memberikan contoh namun beliau telah berhenti setakat itu sahaja.

Dan apabila Menteri Penerangan kita hanya mengulang-ulangkan hujahan-hujahan “cakap senang, buat susah” terhadap lawannya sebentar tadi maka di situlah, pada pendapat saya, debat malam tadi adalah kepunyaan Anwar.

Anwar pun tidaklah menampilkan hujahan-hujahan yang sempurna keseluruhannya. Ada masanya, beliau hanya menggunakan kepetahannya berbicara, menggunakan perkataan dan tidak menampilkan isi yang sewajarnya. Namun begitu, sebagai pencadang, saya kira Anwar telahpun mengemukakan nas-nas yang sepatutnya diutarakan oleh pihak pencadang kepada tajuk perbahasan.

Malangnya Shabery tidak nampak seperti membangkang dengan hujah-hujah yang konkrit apabila terperangkap sedikit dengan emosinya. Yang paling merugikan ruang perbahasan yang memang terbatas tersebut, bila beliau telah dengan terlampau terang “menjual” keterbukaan kerajaan dalam memberikan ruang kepada pembangkang untuk tampil ke arus media perdana sepertimana ruang yang telah diberikan kepada Anwar malam tadi sebagai satu nas hujahan. Maaf, apa kena mengena tajuk pebahasan dengan perkara tersebut?

Namun demikian izinkan saya mengucapkan syabas kepada kedua-dua pendebat dan kita semua kerna dengan berlangsungnya debat sedemikian jelas kita sedang menuju kearah yang betul menjadi masyarakat sivil yang berhemah dan bukannya hanya bijak dalam membuat demonstrasi atau sekatan jalanraya semata-mata.

Semoga banyak lagi debat sebegini akan dapat ditonton oleh kita.

While I was having my roti canai...

I was in the good company of KJ this morning. Not in real time though. He was on TV1 "Live from Parliament" show this morning while I was having my roti canai in one of favourite roti canai joint here in Penang. The guy was on form! I got to give that to him. He was articulate and "straight to the point".

No, no, please don't label me as "KJ fan" just yet. Have mercy! Please, read on.

When asked about what he thinks of the grouses still heard despite his Pa-in-law already agreed to hand over succession of the throne to Najib in 2010 (mid), there was a short answer coming from him. I guess he was being careful not to step on anyone's foot, not to make it sound like the "directives" coming from him last time around.

KJ said those still showing dissatisfaction although the PM already agreed to hand over power is those who will "lose out" when Pa-in-law step down and Najib takes over. These people he said are the one with personal agenda which they won't be able to fulfill in the event of succession of power becomes reality.

I would like to ask, who are these people actually (that will "lose out" eventually when transfer of leadership takes place)?

Is it those UMNO grassroot who wants Najib or Ku Li (or whoever except Pa-in-law) to become their new President now or latest come December 2008 and not somewhere in June 2010? Or is it, the people of Malaysia, like you, who wanted fresh face leading the government now or latest come December 2008 and certainly not somewhere in June 2010?

Who will actually "lose out" when the transfer of power between Pa-in-law and Najib takes place?

Mandat habis akhir tahun di dalam waktu tambahan. Apahak Presiden untuk menyerahkan pada masa yang dia tidak ada mandat lagi. Alangkah pelik UMNO melakukan kita .

Adakah Abdullah seorang yang berkebolehan?

Dia diserahkan kuasa dengan negara sudah dipulihkan. Dia hanya melakukan pembinasaan. Tidak dapat kuasai pentadbiran, lemah, leka/tidor dan mudah dipengaruhi.

Adakah ini satu penyelesaian dengan keadaan negara, bangsa dan parti serta tekanan pembangkang dan tuntutan masyarakat?

Demi menjaga hati, kita mengenepikan kepentingan parti, halatuju perjuangan dan kepentingan bangsa, negara, agama dan parti.

Dalam keadaan yang sangat kritikal kita masih mahu mencari jalan tengah dan menangguh2 lagi. Kita sudah tidak ada masa.

Demi tatasusila dan adab, kenapa Imam yang tidak diterima makmum mahu lagi kekal? Margret Tatcher boleh turun bila akarumbi sudah tidak mahu walaupun mahu dapat 60% undi?

Pak Lah seperti seorang yang gila kuasa. Bukankah tidak ada adab susila Melayu orang yang tidak tahu merendah diri, bersikap ego dan menolak kehendak akarumbi parti dan rakyat?

Bolehkah parti dipulih dalam dua tahun lagi dengan masa lebih kurang dua tahun setengah?

Orang yang tidak tahu dan telah membinasakan ekonomi tidak boleh diharap menghidupkan kembali.

Lame duck hanya siapkan kerja yang ada. Reform tidak boleh dilakuakn oleh seorang PM lame duck tetapi oleh pemimpin yang mahu kekal. Sepatutnya dalam 100 hari sudah cukup masa untuk memahami, selepas itu sepatutnya tindakan dan penyampaian.

Dalam 4 tahun, tidak ada apa2 signifikan yang telah dapat dilakukan! Dia tidak boleh diberi lagi masa.

Persidangan UMNO Cawangan 17 Julai ke 24 Ogos. Bahagian 9 Oktober - 9 November. Agong 16-20 Disember.

Fikirkan apa yang dikata sebelum pergi bersidang.

Sedia berjuang. Tentangi kekangan. Hilangkan ketakutan. Rungkaikan pergantungan.

Berani lakukan perubahan!

Bersuara. Sebarang manipulasi ditentang habis-habisan. Usul diguna untuk nyatakan pendirian. Undi diguna dengan penuh kebijaksanaan dan keberanian.

Paklah bertanya kepada dirinya sendiri...

..."...tang mana yang tak kena ni Paklah?"

Balik daripada makan malam dengan keluarga tadi di Cafe Old Town White Coffee Bayan Baru, saya sempat menonton sebahagian dari Berita jam 8 TV3. Kelihatan paklah sedang berucap di dalam satu majlis bersama NGO.

Paklah dirakamkan berkata bahawa "Dr. Mahathir sendiri pernah katakan, dia mintak maaf di dalam satu persidangan UMNO 3, 4 tahun sebelum dia bersara. Dia mintak maaf kerana dalam pencapaian-pencapaian yang diperolehi di zaman pemerintahnnya, dia masih gagal mengubah perangai bangsanya."

Seterusnya paklah telah mengatakan bahawa semasa mendengar ucapan Dr. Mahathir tersebut, dia di dalam diam-diam berkata kepada dirinya sendiri, "jika ditakdirkan saya memerintah, saya akan usahakan untuk mengubahnya", merujuk kepada usaha mengubah sikap bangsa Melayu.

"Daripada yang terbaik kepada yang terburuk", Perdana Menteri juga memberitahu majlis tersebut berkenaan pencapaiannya di dalam Pilihanraya-pilihanraya Umum yang lepas-lepas. Dia akui bahawa dia memegang rekod yang terbaik dan dia juga adalah pemegang rekod yang terburuk, sehinggakan dia menyambung ucapannya lagi dengan bertanya kepada dirinya sendiri, "tang mana yang tak kena ni paklah?"

Baguslah, saya kira paklah cuba bermuhasabah dengan dirinya sendiri bila menyoal dirinya sedemikian rupa. Cuma saya sedikit gusar, bila persoalan yang ditimbulkan sudahpun mempunyai jawapan. Jawapan yang sangat jelas, terang-benderang. Jawapan yang diberikan sendiri lebih kurang 3 purnama yang lalu.

Pokoknya, bukan sikap rakyat jelata sahaja yang perlu dikesali bila tidak dapat diubah. Sikap pembesar-pembesar juga perlu dikesalkan seandainya langsung tidak diperelokkan, diperindahkan, diubah.

"tang mana yang tak kena ni Paklah?"

Saya kira jawapan yang paling sesuai sekarang ini dari saya kepada Perdana Menteri adalah, "Tang tu kot paklah, tang kita sendiri yang dok pi mai, pi mai tang tu."

The Perak Dilemma

I love Perak. I have lived in Perak throughout my formative years. Kuala Kangsar to be exact.

It was in 1985, at the tender age of 13, I've started living on my own. Well not alone, like really all alone actually. There were others, the other 116 brothers of mine. We learned, played, ate, laughed and cried together. For 5 years.

Because of that Kuala Kangsar and Perak are special to me. It has become my 2nd hometown, my 2nd kampung. Every now and then, whenever I have the opportunity, on my way to KL or on the way back, I would make up an excuse just for that detour to KK town, to have lunch at Yut Loy, to have that quick stop at that old Greco-Roman building.

I guess I never really left Kuala Kangsar. "You can check out anytime you like, but you can never leave", just like the Eagle's "Hotel California"; I keep coming back to KK. Same goes to all of my brethren who had lived the life at that old Greco-Roman building. They'll say to you, "We came hoping to get out, but went crying to stay!" That's how special Kuala Kangsar, Perak to all of us.

But somehow it seems the current Perak is not like the old Perak that I have gotten used to. Laid-back, peaceful and calm, that was the Perak of old. Now, it's becoming more unlike Perak.

There's a sense of uncertainty. There's this uneasy feeling, looseness and something that I couldn't quite put my finger on. Read this, Perak MB denies Pangkor 2 Agreement with DAP and this, Barisan not buying over Pakatan Rakyat assemblymen: Tajol Rosli and I think you'll understand.

There's even issue like this, Pelajar hampa gagal tuntut ganjaran RM1,000 diumumkan MB Perak cropping out.

Primitive Politics? Power-broking gone wrong? Could those be it?

Gah sungguh bunyinya!


Jangan pertikai tempoh peralihan kuasa – Khairy

KUALA TERENGGANU 11 Julai – Pelbagai pihak diminta tidak mempertikaikan tempoh dua tahun peralihan kuasa Perdana Menteri, Datuk Seri Abdullah Ahmad Badawi kepada timbalannya, Datuk Seri Najib Tun Razak.

Naib Ketua Pergerakan Pemuda UMNO, Khairy Jamaluddin berkata, para pemimpin UMNO juga tidak sepatutnya mempersoalkan isu jangka masa itu kerana ia telah dipersetujui di antara Abdullah dan Najib.

Katanya, pelan peralihan kuasa berkenaan dilakukan secara tersusun dan mampu mengukuhkan lagi parti.- Utusan.

Jika dikenangkan usia setahun jagung di dalam kepimpinan UMNO orang yang memberi arahan ini dan kepada siapa "arahan" ini ditujukan, jelas perbedaan langit dan bumi. Siapa yang pertikaikan? Semalam daripada coretan-coretan berita aliran perdana dan alternatif, yang saya kira nampak mempertikaikan atau bahasa yang lebih halus, "memberikan pandangan" alternatif mereka (bukan "saya sokong" semata) adalah antaranya Muhyiddin dan Ku Li.

Agak-agaknya apakah nombor keahlian UMNO kedua veteran UMNO ini jika dibandingkan dengan anak menantu Perdana Menteri ini? Mungkin jauh berjuta angka nombor-nombor siri keahlian kedua-dua pemimpin UMNO daripada saudara Khairy Jamaluddin ini.

"Pelbagai pihak" itu pula siapa? Saya tidak mahu menganggap bahawa arahan itu adalah kepada kami, orang-orang di luar UMNO. Itu boleh menimbulkan amarah kami pacal-pacal rakyat yang hina ini! Itu tidak elok untuk tujuan pemulihan UMNO di kaca mata kami, bukan?

Jadi, adakah ianya ditujukan kepada ahli-ahli di peringkat akar-umbi? Maaf saya bertanya, inikah yang dikatakan "demokrasi" ala-UMNO jika ahli-ahli dan pemimpin adalah dilarang untuk menyuarakan pendapat?

Jika Muhkriz menegur pemimpin nombor wahid UMNO dianggap biadap, apa pula kategori "arahan" atau lebih tepat lagi tempelakan si KJ ini terhadap para seniornya yang masing-masing merupakan Naib Presiden dan mantan Naib Presiden UMNO?

Adakah wujud dua set peraturan ataupun perlaksaan peraturan dan tata-tertib di dalam UMNO? Satu set undang-undang dan peraturan untuk ahli seperti Mukhriz dan satu set lagi untuk ahli seperti Khairy?

Mungkin ahli-ahli UMNO boleh membantu saya dalam menjawab persoalan-persoalan ini. Maafkan saya kerana jahil dalam perkara ini, saya bukan ahli UMNO.

Kita faham dua tahun satu masa yang singkat. Jadi terdapat keperluan untuk bergegas dalam menonjolkan diri sebagai "wira". Tetapi janganlah sampai seperti "mengarah" orang yang lebih tua dan lebih tinggi pangkatnya daripada kita.

Tidak manis begitu. Kita orang timur, kaya dengan adab dan sopan.

That Deadly Tai-Chi Moves!

And with another one equally slow move, here comes KJ and friends to the throne.

There was a standing ovation too after the announcement was made apparently. They must have loved those tai-chi moves he made! Paklah has this to say with regard to that,

He believed the Umno divisions accepted his transition plan well because "they gave me a standing ovation." Read more here.

Just for that standing ovation, he already felt that way. That he already got the endorsements from all the UMNO divisions. Can you believe this guy? Is he for real or what?
